3.1 Things to note when signing a contract appendix

When signing a contract appendix, businesses need to note the following points to ensure accuracy and validity.

• The content of the appendix to the model contract is always consistent with the content of the main contract. If there are any provisions contrary to the contract, the provisions in the appendix to the contract are invalid.
• The person signing the contract appendix must have the same position as the main contract signatory.
• The content of the contract appendix must clearly state the effective date.
• The form of the contract appendix and the main contract must be identical.
• The appendix to the labor contract can only be amended once. Other appendices to the contract do not specify the maximum number of appendices that can be signed.
• If the contract has many appendices, the executor must number them in ascending order according to the time of signing.

3.2 How many times is the contract appendix signed?

According to the provisions of the 2015 Civil Code , the maximum number of times a contract appendix can be signed is not limited. Therefore, the number of times it can be signed will depend on the level and details of the contract as well as the will of the parties involved.

However, it is clearly stipulated that the labor contract can only be amended a maximum of once and cannot change the type of contract signed, except in cases of extending the contract term for elderly workers and non-professional union officials.

According to Article 22 of the 2019 Labor Code, the contract appendix is built on the basis of legal effect equivalent to the contract.
